M. Elizabeth Cirone

Elizabeth Cirone is a senior associate in the San Jose office of Hopkins & Carley and a member of the Real Estate Practice Group.  Liz has extensive trial experience in many types of complex litigation, with a particular emphasis on construction and real estate related disputes.  In addition to extensive litigation experience, Liz often consults on contract drafting and negotiation for both commercial and residential real estate projects.

Liz often represents property owners, landlords, tenants, prime contractors, subcontractors, material suppliers, and design professionals on matters involving:

  • Construction contract claims
  • Mechanic’s liens and stop notices
  • Multi-party construction defect litigation
  • Real property disputes, including easements, partitions, and options
  • Lease disputes

Prior to joining Hopkins & Carley, Liz was with Bustamante, O’Hara & Gagliasso, where her practice included the defense of construction professionals and tradespersons in construction defect lawsuits.

  • Successfully represented home owner in a bench trial regarding breach of contract and defective construction claims in excess of $20 million against the contractor and architect; successfully defended same client against claims for prompt payment penalties by contractor through motion for judgment following contractor’s presentation of evidence.
  • Obtained a complete “defense” judgment in the face of claims in excess of $400 million brought by a beneficiary against a company and its trustees.  The judgment was obtained after a 21-day trial involving complicated business valuation, fiduciary duty, accounting, fraud, and punitive damages allegations.  The hard-fought defense judgment, and extensive cost award,  were subsequently affirmed in full on appeal, with the Supreme Court denying a petition for review.
  • Successfully obtained summary judgment before trial on behalf of property owner against subcontractor performing work on premises on behalf of commercial tenant without owner’s consent and which resulted in injuries to employee of tenant.
  • Successfully represented multinational technology company in multi-million dollar international arbitration involving claims for breach of contract and misappropriation of trade secrets.
